A trial court in Pune on Tuesday sentenced three convicts to death in connection with a 2009 case of abduction, gangrape and murder of a software engineer, reported ANI. Yogesh Raut, Mahesh Thakur and Vishwas Kadam were convicted of kidnapping and killing Nayana Pujari, who was attacked on her way home on October 7, 2009.

The court, however, held that the prosecution could not prove charges punishable under Sections 364 (kidnapping), 394 (voluntarily causing hurt in committing robbery) and 201 (causing disappearance of evidence of crime). Rajesh Chaudhary, the fourth accused, turned an approver as he was involved in rape, but did not have any role in murder. The three repeatedly raped her in the moving vehicle and then stopped at a desolate spot, where they snatched her debit card, forced her to reveal the pin at knife-point and later withdrew total of Rs 61,000 from her account.

The prosecution told the court that the investigation revealed that the victim was kidnapped and later gang-raped in a vehicle. Also, when the trial was underway, main accused Raut escaped from the Sassoon Hospital in Pune on September 17, 2011, while being escorted to the hospital for medical treatment. He was, however, arrested from Shirdi 20 months later.

During the final arguments, Special Public Prosecutor Harshad Nimbalkar claimed to have established a complete chain of circumstances that led to the crime and hoped that the court will pronounce the accused guilty and award them the highest punishment for the gruesome crime. The prosecution and the defence examined 37 and 13 witnesses, respectively, in support of their case. The maximum sentence the three convicts can attract on these counts is a death penalty or life in prison. The case has been heard by four judges in last six years.

The brutal rape and murder of Nayana Pujari had brought to the fore the lack of security for women working in the IT and BPO sectors.
