Judge E. Susan Garsh threw out the murder conviction of Aaron Hernandez in the Odin L. Lloyd case and dismissed any charges against him Tuesday, according to Maria Cramer and John R. Ellement of the Boston Globe.

Susan Garsh said she "has no choice" but to throw out Hernandez's murder conviction and dismiss the charges against him in accordance with MA state law.

Prosecutors argued that Hernandez killed himself because he had knowledge that his conviction would be vacated, and that was grounds for keeping the conviction in place.

"This court can not know why Hernandez chose to end his life", Garsh said, adding that suicide is a "complex act that may have myriad causes".

Lloyd's mother fought back tears after the ruling Tuesday, saying the former New England Patriots tight end would always be guilty in the eyes of her family. She also said a "possible mental disturbance" was reflected in a suicide note to his fiancee in which he said his death was "the Supremes, the almightys plan, not mine".

The legal doctrine behind today's ruling is known as abatement ab initio ("from the beginning").

Hernandez's appellate attorney told the judge that the state's highest court has applied the legal doctrine "without exception", even in cases of suicide. Thompson also said because Hernandez died in prison, it will be hard to definitively determine how he died.

MA law says murder convictions are abated, effectively erased, after an inmate's death if the inmate's appeals options have not been exhausted.

The defense asked that its motion be heard at the same time the judge considers whether to erase Hernandez's conviction.

His death came five days after he was acquitted in a 2012 double murder.

Hernandez's appellate attorneys made their request under a long-standing legal principle holding that when defendants die before their direct appeal is decided, their convictions are vacated.

Hernandez's defense attorneys asked the court to follow that procedure and toss out his April 2015 murder conviction for killing Lloyd.
