Pakistan moves ICJ to rehear Jadhav case

The Pakistan government on Friday filed a plea in the International Court of Justice to rehear within six weeks the case of alleged Indian spy Kulbhushan Jadhav, sentenced to death by a Pakistani military court.

He said the ICJ had given its point of view on Jadhav's case to get counselor access.

The 4-feet high sculpture was created by using about three tons of sand, he said.

Salve demanded that Pakistan should annul Jadhav's death sentence as he was not even given a chance to defend himself.

He said he has always tried to spread messages through his sand sculpture around the world.

India approached the ICJ on May 8, accusing Pakistan of "egregious violations" of the Vienna Convention in the matter of the detention and trial of Jadhav.

India may succeed in persuading the Council to save Jadhav from a certain gallows, if China among the five permanent members has no right to veto in favour of Pakistan, its ally.

He said that Attorney General should have been sent in the International Court of Justice (ICJ) to represent Pakistan in the case.

According to government sources, since the case has reached the worldwide court, it is incumbent on Pakistan to produce "material evidence" about his whereabout and well- being.

Foreign Office Spokesman Nafees Zakaria said the decision to challenge the ICJ's jurisdiction was taken after consultation with all government institutions and agencies.

He pointed out that there exists a bilateral pact on consular access between Pakistan and India since 2008 and added that Article 6 of the pact exclusively relates to consular access being determined on the merit of the case.

"India misled the court and we have shown that", he said, urging the media to show restraint and not spread false news.

"Pakistan's security is so important and we have to maintain our fundamental sovereign right", Aziz was quoted as saying by the daily.

Officials of both the countries were present when the judge asked the registrar to communicate the order to both the parties.

"I can conclude that this was a political decision, based on the influence of India with the worldwide community", he said.
