Bill Cosby Faces Retrial In Sex Assault Case

Ben Pena | 18 June, 2017, 15:29

The judge in famed American stand-up comedian Bill Cosby's sexual-assault case declared a mistrial on Saturday, after the jury was unable to reach a verdict following six days of deliberations.

Prosecutors said Cosby, 79, drugged and sexually assaulted Andrea Constand, the former director of operations for Temple University's women's basketball team, at his home near Philadelphia in January 2004.

A judge has declared a mistrial in the Bill Cosby sex assault case because the jury says it is hopelessly deadlocked.

Women bringing civil cases would also likely find it easier to introduce testimony from other accusers to support claims that Cosby engaged in a pattern of assault, said Douglas Wigdor, a plaintiffs' attorney who represents clients in sexual harassment cases.

Some of the many women who accused Mr Cosby of drugging and assaulting them over a 40-year time span were present in court last week awaiting the verdict.

A few of Cosby's accusers sat behind her and some sobbed as the judge declared the case a mistrial.

Cosby will remain free on $1 million bail.

"She's a very spiritual woman, she believes things happen for a objective, and I think the goal is ... it should encourage other women to come forward and have their day in court", Ms Troiani said. The district attorney at the time declined to press charges, citing insufficient evidence.

She said the incident left her "humiliated" by someone she had thought of as a friend and mentor. Then, prosecutors would get four months to decide whether they want to retry Cosby or drop the charges.

"He thought he could bury us", accuser Linda Kirkpatrick said of Cosby outside the courtroom in Norristown, Pennsylvania.

By Thursday morning, after almost 30 hours of discussions spanning three days, the jurors told O'Neill they were at a stalemate.

Bill Cosby's sexual assault trial ended in a mistrial late last night (June 16).

If they can't break the deadlock, O'Neill could declare a hung jury and a mistrial.

Cosby's publicist Andrew Wyatt: "Mr. Cosby's power is back".

Constand testified she had been given three pills and became "frozen" and "semi-unconscious" and described being sexually touched by Cosby in his Philadelphia mansion. The judge instructed them to keep working, but despite marathon 12-hour sessions, the jury said on Saturday it was at an impasse. "I see you. I love you". It wasn't immediately known how many jurors wanted to convict and how many wanted to acquit.

In a strongly-worded statement read by an aide, Bill Cosby's wife, Camille, took aim at the prosecutor, who she called "heinously and exploitatively ambitious", and the judge who she described as "overtly arrogant".

The spokesman also accused high-profile women's rights attorney Gloria Allred of conspiring against Cosby.
