Cosby jury asks for definition of reasonable doubt

Freda Brock | 28 June, 2017, 02:15

The jury in the Norristown, Pa., courthouse also requested that the judge read aloud portions of deposition testimony from the trial involving Cosby's past purchase of Quaaludes to facilitate sex with women. The judge overseeing the trial reread instructions he had given jurors Monday, reminding them to "discuss the case with one another, and deliberate with a view toward reaching agreement, if you can do so without violating your individual judgment".

The jurors' questions early Friday signaled they were working to overcome the impasse they reported to the judge Thursday.

They also asked for clarity around the language of count three, which pertains to whether Cosby administered "drugs, intoxicants or other means for the objective of preventing resistance" without Constand's knowledge, as well as clarification about Constand's testimony about the alleged attack and read-backs of police testimony about Cosby's 2005 interview with police.

They specifically asked for the testimony where Cosby admits to giving women prescription Quaaludes before sleeping with them in the 1970s. The defense made a motion for a mistrial again due to the length of deliberations, but O'Neill denied the motion because the jury is actively deliberating, she added. If convicted, Cosby could be sentenced to up to 10 years in prison on each count. Judge Steven O'Neill told the jury he could not provide additional information.

Even as his attorney demanded a mistrial, Cosby himself thanked jurors for "their long days" and "their honest work, individually".

University of Pennsylvania law professor David Rudovsky, a criminal lawyer in Philadelphia, said Thursday that the jurors' inability to agree on a verdict didn't surprise him, given the nature of a case that boiled down to Cosby's word against his accuser's and the legal meaning of consent. In those interviews, Cosby admitted to sexual contact with Constand and said they had previously had a romantic encounter.

Chicago Cops Indicted For Laquan McDonald Killing Cover-Up
Initial police reports indicated that McDonald was swinging at and threatening Van Dyke and other officers on the scene. The indictments stem from a 2014 incident in which Laquan McDonald, 17, was shot to death by a white police officer.

"I learned more from him than I did from her", she said during her testimony, in reference to a phone conversation she had with Andrea a year after the alleged incident. And it means they are doing more than just fixating on Constand's behaviour after the alleged assault - the phone calls, gifts and attendance at his comedy show.

Prosecutors say his prior use of Quaaludes shows that Cosby had knowledge of what he was doing when he gave her the pills. Cosby is accused of drugging and sexually assaulting Andrea Constand at his Cheltenham Township home in 2004.

Cosby testified in a 2006 deposition that he got seven prescriptions for the powerful sedative in the 1970s for the objective of giving them to women before sex.

Jurors have started to test the patience of the judge in Bill Cosby's sexual assault trial.

According to testimony from her 2005 civil suit, Constand said Cosby invited her to his house. In that case, prosecutors would get four months to decide whether they want to retry Cosby or drop the charges.

The Associated Press does not typically identify people who say they are victims of sexual assault unless they grant permission, which Constand has done.
