The Supreme Court is set to hear a case involving a Christian baker who denied a wedding cake to a Colorado couple because they were gay.

Phillips' legal battle began several years ago, when Charlie Craig and David Mullins came in to order a cake for their wedding reception.

Colorado did not permit same-sex couples to marry until 2014.

Around 61 per cent of Americans think businesses should not be allowed to refuse gay people goods or services, even if doing so violates their religious beliefs, the survey from PRRI found.

The Supreme Court overturned that ruling today, arguing that Obergefell v. Hodges in 2015 did not just allow same-sex couple to marry, but also required that same-sex married couples get the same rights as opposite-sex married couples.

Early this month, the Idaho Supreme Court denied custody and visitation rights to a gay woman who raised a child with her former partner in a decision that reflected state laws that have not been updated since same-sex marriage was legalized.

The court took up an appeal by Jack Phillips, a baker who runs Masterpiece Cakeshop in Lakewood, just outside Denver, of a state court ruling that his refusal violated a Colorado anti-discrimination law.

"The constitution guarantees me the right to practice my faith, my religion, anywhere, any time", Phillips said in 2015.

About a half-dozen other artists in the wedding industry are challenging state laws requiring them to produce work for same-sex ceremonies. Gorsuch has so far been one of the more conservative members of the high court. His arguments lost in Colorado courts, but will now move on to the Supreme Court.

In a separate opinion, Gorsuch, joined by Justice Clarence Thomas, clarified that the case should be applied broadly throughout the country to make it clear discrimination against religious practice isn't tolerated on the playground or anywhere else.

The landmark case was taken up on Monday - two years to the day after America's top court legalised same-sex marriage nationwide.

Craig and Mullins filed a civil rights complaint and won, first before an administrative court judge, then before the state Civil Rights Commission, and finally before the Colorado Court of Appeals.
