Attorneys representing Brendan Dassey, the nephew of the show's main subject Stephen Avery who was convicted alongside his uncle for the rape and murder of Teresa Halbach, are challenging the state of Wisconsin's motion to keep Dassey in prison despite his conviction being overturned in 2016.

On Thursday, June 22nd the 7th Circuit Court of Appeals affirmed a decision by a judge to overturn Dassey's conviction. The panel also ordered Dassey to be released if state attorneys decided not to retry him within 90 days.

"We anticipate seeking review by the entire 7th Circuit or the United States Supreme Court and hope that today's erroneous decision will be reversed", he said in an email.

The state Department of Justice's filing argues Brendan Dassey should remain in prison because his case is far from settled.

Avery, 54, is now in prison serving a life sentence with no chance of parole.

"We look forward to working to secure his release from prison as soon as possible", said Dassey's lawyers in a joint statement. Prosecutor Ken Kratz wrote in his book "Avery" that Dassey was "a shuffling, mumbling young man with bad skin and broken-bowl haircut" who could have rescued Halbach but instead involved himself in her rape and murder. The lawyers pointed out the convict will be harmful to public if released. Avery was sentenced to life as well in a separate trial. "We continue to send our condolences to the Halbach family as they have to suffer through another attempt by Mr. Dassey to re-litigate his guilty verdict and sentence".

Dassey's lawyers are from the Center on Wrongful Convictions of Youth at Northwestern University.

It was ruled his constitutional rights were violated when investigators coerced him into a confession and made false promises during interrogations. The Constitution is not offended by such police tactics as encouraging the subject to tell the truth, bluffing about what the police already know, or confronting the subject with what the police know from physical evidence.
