SC Grants Bail to Shrikant Prasad Purohit in 2008 Malegaon Blast Case

Randeep Singh Surjewala, the All India Congress Committee (AICC) in-charge of communications department, said Purohit getting bail was neither a reflection of his guilt nor innocence as he was facing a trial. "Till then he will be under open arrest, which means he would be attached to a unit and is allowed to wear his uniform", an Army source said.

The liberty of a citizen is undoubtedly important but this is to balance with the security of the community, the court said while pointing out that a balance was required to be maintained between the personal liberty of the accused and the investigation rights of the agency.

The Supreme Court on Monday granted bail to 2008 Malegaon blast accused Lt Colonel Prasad Shrikant Purohit.

Earlier, a bench of Justices RK Agrawal and MM Shantanagoudar observed that the issue of granting bail to Purohit and cancellation of bail of Pragya Singh Thakur, also accused in the case, needed detailed consideration, as both the pleas are on similar facts.

On the other hand, the Shiv Sena welcomed the Supreme Court's decision to grant bail to Purohit and hailed him as a "hero" who fought against terrorists."Lt. Col. Shrikant Purohit is a hero of the nation".

The suspended Army officer had challenged the April 25 Bombay High Court order that granted bail to co-accused Sadhvi Pragya Singh Thakur but rejected his bail plea. The court set aside Bombay High Court order denying bail to Purohit in the terror case. The Supreme Court today granted bail to Lt Col Shrikant Prasad Purohit in the 2008 Malegaon serial blasts case.

The NIA, Salve claimed, had filed a new chargesheet in the case which contradicts the agency's claims made in its earlier chargesheets. Purohit, however, said he was there to spy on the group members and had kept his seniors in the loop on all developments.

According to a New Indian Express report, the NIA had previous year alleged that Pandey had instructed Purohit to arrange explosive RDX, while Thakur owned the motorcycle used in the blast.

In its charge sheet, the agency alleged the suspect had selected Malegaon town for the 2008 bombings because of its sizeable Muslim population.

It further alleged that it was Pandey who had instructed Purohit to arrange the RDX, while Thakur owned the motorcycle which was used in the blast.
