According to the sources, the AG has observed that since the collector's report has been challenged by Chandy, it was up to the state government whether to wait for the court's verdict or take a decision on the report before that.

The Nationalist Congress Party today rejected demands for resignation of its nominee in the CPI (M)-led LDF government in Kerala, Thomas Chandy, who is facing charges of lake encroachment in Alappuzha district.

Speaking in a public meeting at Kanjirappally, Pannyan called for Thomas Chandy's resignation on the basis of Alappuzha District Collector TV Anupama's report.

In a surprise move, the tainted left minister Thomas Chandy has roped in senior Supreme Court lawyer to appear for him in the Kerala High Court. Chandy, who belongs to the NCP, became a minister eight months ago, following the resignation of A K Saseendran from the State cabinet over the issue of a sleaze talk with a woman.

The resignation of Chandy - or his removal from Cabinet - has become nearly unavoidable following the State Advocate General's advice to the Government which has so far defended him that the Alappuzha District Collector's report describing that violation of rules by him can not be ignored and that is now up to the Government to take appropriate action against him.

The CPI has taken a strong stand against Thomas Chandy in the land encroachment issue from the beginning.

The NCP leadership, which is expected to meet at Kochi on Tuesday, was asked to inform about its decision to Vijayan in this regard after its parleys, the LDF leader said. The findings of the district collectors report cannot be ignored, the sources said.

"The talks were satisfactory...the CPI is happy", he said.

Chief Minister Pinarayi, who had forced his own party's central committee member EP Jayarajan to quit as Industries minister within a few days after he was accused of nepotism and made Saseendran resign within hours of the eruption of the sex scandal, had vehemently justified and defended Chandy whenever the issue came up in the Assembly. He said the allegations were levelled only to target him "with the set agenda orchestrated" by his political rivals, interested parties, and the media conjointly.

Mr Rajasekharan also said that the UDF did not have any right to demand Chandy's resignation as they had allowed him to encroach on the land in Alappuzha.
