US SC to review Trump travel ban

Justice Dept. to Appeal Ruling That Blocked DACA Shutdown US SC to review Trump travel ban

The United States Supreme Court agreed to review the ruling of the 9th Circuit Court of Appeals striking down the third version of President Trump's travel ban.

A decision could take more than a year if the court takes up the case but declines to speed up resolution of it issuing a ruling in its current term.

The ban restricts travel from eight nations, six of them predominantly Muslim. Trump's policy targets people from Chad, Iran, Libya, Somalia, Syria and Yemen.

In December, in a sign that the Supreme Court may be more receptive to upholding the September order, the court allowed it to go into effect as the case moved forward. The justices said the issue was now moot.

Originally Trump targeted six Muslim nations in the first version of the ban, targeting nations whose people may pose a threat to USA security as the billionaire made good on a campaign promise.

The latest travel ban says that the countries "remain deficient at this time with respect to their identity-management and information-sharing capabilities, protocols, and practices".

At issue is a ruling by federal District Judge William Alsup who blocked the plan to end DACA and said the Trump administration must resume receiving DACA renewal applications.

"We have always known this case would ultimately be decided by the United States Supreme Court", said state Attorney General Doug Chin of Hawaii, which has repeatedly fought the travel bans.

Late past year, the justices allowed the entire travel ban issued in September to go into effect pending appeal. "This will be an important day for justice and the rule of law".

In a separate development Friday, the federal appeals court in Chicago heard oral arguments on whether the Trump administration is overstepping its authority by withholding public safety grants from sanctuary cities, including Chicago, unless they fully enforce immigration laws.

Trump's initial travel ban, decreed a week after he took office, triggered chaos out at U.S. airports, with travelers detained upon arrival, and nationwide protests against a measure seen as discriminatory - though Trump said it aimed to keep out extremists. Last month, the U.S. Court of Appeals for the 9th Circuit agreed. The Justice Department appealed to the 7th Circuit in a bid to reverse a lower-court ruling the policy.

A third version would be permanent and the Associated Press (AP) said the White House had argued it was the product of a thorough review by several agencies.

In his brief urging the Supreme Court to hear the case, Solicitor General Noel J. Francisco wrote that the president has vast constitutional and statutory authority over immigration.

The Constitution gives Congress the power to set the law on immigration, and the president is given the duty to enforce it.
