Schumer: Trump picked Kavanaugh for protection from Mueller

No deference should be afforded there, or any other area where the government has been delegated authority, but where our laws make it clear the judiciary has the last word.

Speaking on the Senate floor Monday morning, Schumer said Kavanaugh's paperwork 'will be critical to helping Americans understand what kind of judge he will be.' He added that 'if that takes more time, so be it'.

Kavanaugh thanked the president, praising him as the most diligent in searching for excellent judges.

The White House said Democrats will do what ever they can to slow down a vote on Kavanaugh. He worked on W.'s legal team during the hanging chads fiasco; he also represented former Florida governor and presidential candidate Jeb Bush in a 2000 lawsuit over school vouchers in the Sunshine State. But his supporters have cited his experience and wide range of legal opinions.

Republicans are eager for conservatives to gain a firm majority on the court. Previous year the president appointed Neil Gorsuch after the Senate refused to consider Barack Obama's nomination, Merrick Garland, to replace the late Antonin Scalia.

Senate Majority Leader Mitch McConnell, R-Kentucky, who once held a court seat open for almost a year before the 2016 election to keep former President Barack Obama from filling it, lambasted Democrats for announcing their opposition before Trump had decided on a nominee.

Some Republican senators had favored other options. Kavanaugh faced a long confirmation battle when Bush nominated him to his current post in 2003.

Democrats and liberal advocacy groups quickly lined up in opposition. "I will tell each senator that I revere the Constitution", he said.

Kavanaugh, whose wife and two daughters were with him Monday night, said he was "deeply humbled" by the nomination.

If confirmed, Kavanaugh would replace a frequent swing vote on the bench, retiring Justice Anthony Kennedy, who often sided with his liberal colleagues on issues such as abortion, affirmative action and LGBT rights.

He joined the U.S. Court of Appeals for the District of Columbia Circuit in 2006. He served on the team of independent counsel Ken Starr during Starr's investigation of the Clinton White House. He is a Yale Law School graduate.

He wrote a Minnesota law review article in 2009 arguing that presidents should be shielded from criminal investigations and civil lawsuits while in office. That view has particular relevance as special counsel Robert Mueller is looking into Russian meddling in the 2016 election and whether the Trump campaign played any role in a foreign interference plot.

"I'm deeply honored to be nominated to fill his seat on The Supreme Court", Brett said.
