Texas juvenile judge frees most defendants after losing re-election to Democrat

Public defender Steve Halpert quoted Devlin as saying, "This is obviously what the voters wanted", and opined that Devlin, a Republican, meant to imply that Democratic judges are more lenient with accused criminals.

"Judge Devlin's mass release of children. without any apparent concern for the children's safety or for ensuring that they are released to their parents, proves his detachment from the needs of each child", Sharon Watkins Jones with the ACLU of Texas said in the statement.

A day after losing his re-election bid, a Texas judge released almost all of the juvenile defendants who appeared before him after asking them whether they meant to kill anyone. A Houston Chronicle investigation earlier this year found that Devlin and one other judge in the county, John Phillips, were responsible for more than one in five minors sent to juvenile prisons across all of Texas in 2017.

ABC 13 reporter Jeff Ehling shared Thursday morning that Judge Glenn Devlin was not in court for the day, and that court staff was unable to answer questions about when he might return. "Apparently he was saying that's what the voters wanted".

Devlin, a longtime Republican jurist who has been a presiding judge in the 313th District Court since 2010, was one of dozens of Republicans who had their seats snatched by a Democrat in the state in Tuesday's midterm election.

Devlin did not respond to a request for comment from the local news outlet.

"We oppose the wholesale release of violent offenders at any age", Harris County District Attorney Kim Ogg said in a statement afterward. Four of the released youths were facing aggravated robbery charges.

Law says that youth defendants are entitled to a detention hearing every 10 days, the Chronicle reported.

Judge Glenn Devlin is a hard-nosed Republican who rules in juvenile cases in Harris county, Texas.

"But nobody has seen this before", he added.

According to Halpert, Devlin asked each defendant "If I release you, will you go out and murder anybody?".

Judge Devlin also rescheduled all of the cases to be heard during the first week of January, which is when Democrat Natalia Oakes will take the bench.

"I'm not sure that I can wrap my [mind] around what he's actually doing", Alex Bunin, Harris County's chief public defender said.
