US Immigration Officials Move to Deny Asylum at Border 8 November 2018

The asylum section of the Immigration and Nationality Act says a migrant is allowed to make a claim up to a year after arriving in the USA, and it doesn't matter how they arrive - illegally or through a border crossing.

The interim final rule to limit asylum proposed on November 8, 2018, by the Trump Administration is the latest attempt to shut American doors to people fleeing persecution and violence, Human Rights Watch said today.

Migrants would only be eligible for asylum if they came through official ports of entry.

The new rule comes as a so-called caravan of migrants from Central America travels north by foot through Mexico to the USA border.

The move would largely affect migrants from Central America's Northern Triangle - Guatemala, Honduras and El Salvador - who cross the USA border with Mexico to flee violence and poverty in their home countries.

"US law is crystal clear that asylum seekers have the right to lodge asylum claims regardless of where they enter the country, and President Trump can not change the law on a whim", said Bill Frelick, Refugee Rights director at Human Rights Watch.

The administration's plan, which invokes the same authority Trump used to justify his travel ban on citizens of several Muslim-majority nations, is likely to be quickly challenged in court. "It is illegal to circumvent that by agency or presidential decree", Omar Jadwat, director of the ACLU's Immigrants' Rights Project, responded in in a statement.

Republican win in Indiana makes Democrat path to Senate majority trickier

"The vast majority of these applications eventually turn out to be non-meritorious", a senior administration official said, asking not to be identified.

The busy ports of entry already had long lines and waits, forcing immigration officials to tell some migrants to come back to make their claims.

This summer, multiple news outlets reported that hundreds of migrants who had legally presented themselves to USA agents at official ports of entry, like San Ysidro, California and El Paso, Texas, were told that their asylum requests could not be processed.

In 2018, border patrols have registered more than 400,000 illegal border crossers, homeland security said.

Administration officials argue the asylum system is abused by people who are not seeking security in the US but are instead searching for economic opportunity or trying to reunite with family members.

It only would affect immigrants who seek asylum after the issuance of a presidential proclamation.

"Congress has directly spoken to this question as to whether individuals can be rendered ineligible for asylum if they cross between ports of entry and has specifically said people are eligible regardless of where they cross", said Lee Gelernt, an attorney with the American Civil Liberties Union. Most have passed largely unnoticed.
