Justices Thomas, Neil Gorsuch and Samuel Alito dissented with Thomas' claim that the Supreme Court created the confusion and therefore, should be responsible for clearing it up.

The news on Monday may come as some consolation to abortion rights advocates who opposed Kavanaugh, fearing that the judge - who was replacing moderate retiring Justice Anthony Kennedy - would immediately work to restrict access to abortions. John Jay hated the court because it didn't get to throw its weight around in politics.

The Medicaid reimbursement issue may indeed re-emerge in another context, and the Court should take up the issue. But when it comes to this Supreme Court, even a less-bad day is a good one. That issue is ripe for Supreme Court review, Thomas argues.

So what explains the Court's refusal to do its job here?

The justices left in place decisions by two lower courts that stopped Kansas and Louisiana from stripping Medicaid money from the reproductive health care organization. The money is not used for abortions. Planned Parenthood of Kansas and Mid-Missouri, both questioned whether Medicaid recipients have the right to challenge a state's decision to block Planned Parenthood from receiving federal funding.

Marjorie Dannenfelser, president of Susan B. Anthony List, said she is "disappointed" in the Supreme Court's rejection of the cases.

The organization sued the states, arguing the Medicaid Act includes a provision saying beneficiaries are allowed to go to any health provider that is "qualified to perform" the medical services they need.

While Trump has suffered a series of setbacks in lower federal courts since taking office a year ago, he has collected major victories at the Supreme Court.

In response to the news that the high court would not be hearing cases that might have eliminated the taxpayer funding Planned Parenthood receives via Medicaid, Kristan Hawkins, president of Students for Life of America, said the rejection amounts to another example of how "taxation without representation lives on today".

The court's decision not to decide strongly suggests that a majority of justices, led by Roberts, would like to keep a low profile this term.

After weeks of debate behind closed doors, a divided court turned down appeals backed by 13 conservative states that sought to defund Planned Parenthood.

We support their right to redirect taxpayer funds away from entities that destroy innocent lives and instead fund comprehensive community health care alternatives that outnumber Planned Parenthood facilities at least 20 to one nationwide.

Louisiana and Kansas announced Republican-backed plans to terminate funding for Planned Parenthood through Medicaid after an anti-abortion group released videos in 2015 purporting to show Planned Parenthood executives negotiating the for-profit sale of fetal tissue and body parts.

Thomas called the issue "important and recurring".

The cases are Gee v. "Those services are barely offered, if at all at some Planned Parenthoods", added Johnson. But a closer look at the details of the case reveals that there's more to it than that.
