A ruling by a Federal judge in the United States, which had declared health care reform "Obamacare" to be unconstitutional, does not occur for the time being in force. The five justices who upheld the health law in 2012 in the first major case - Chief Justice John Roberts and the court's four liberals - are all still serving.

The 17 state attorneys general defending the ACA in lieu of the DOJ, which announced in June it would not defend the ACA, said O'Connor's decision lacked clarity, and filed an expedited motion seeking to continue the defense of the ACA.

O'Connor said "everyday Americans would otherwise face great uncertainty" if he didn't allow the ACA to stand during the appeals process.

The fight now pivots to the U.S. Court of Appeals for the Fifth Circuit.

In the order he issued on Sunday, O'Connor expressed confidence that the appellate bench will concur with his decision that the individual mandate can't be separated from the rest of the law.

O'Connor's original ruling was criticized even by some conservative legal scholars, who suggested the judge may have misread the law and acted himself as a judicial activist.

"In some ways, the question before the Court involves the intent of both the 2010 and 2017 Congresses", O'Connor wrote in his 55-page decision. A spokesperson for California Attorney General Xavier Becerra - who's joined by 16 other states defending the ACA - said his state is "prepared to appeal the December 14 decision imminently".
