Improbable joins forces with Epic following spat with Unity

The change jeopardises the lineup of current and future games developed on Unity and Improbable's SpatialOS, which remains a nascent platform.

On Thursday, British developer Improbable published a post on their official blog stating that games that made use of the Unity engine would no longer be able to use the SpatialOS cloud platform, owing to a change in Unity's terms of service at the end of past year.

Section 2.4 of Unity's software terms of service forbids streaming or broadcasting Unity software, including the Unity Runtime, if it's executed or simulated by a remote server and transmitted over any network to an end user device without a separate license from Unity.

The letter acknowledges the spat between Unity and Improbable and hints that developers are "concerned" about the future of their games.

Unity reportedly changed its terms of service to specifically disallow services like SpatialOS from functioning with its game engine, Improbable said in a blog post on Thursday. "Live games are now in legal limbo".

There may be something specific about SpartialOS's architecture that presents problems for Unity: Rather than using a single, authoritative server to oversee a unified game world for multiple clients - a common setup in gaming - it coordinates multiple servers through various server-side worker programs.

'Overnight, this is an action by Unity that has immediately done harm to projects across the industry, including those of extremely vulnerable or small scale developers and damaged major projects in development over many years.

Other studios have taken a more cautious tone, such as Bossa Studios, the developers of Worlds Adrift. Improbable is looking to continue talks with Unity, but in the short-term hundreds of games both in development and released will be affected by the change.

"SpatialOS [has made] it easier [for me] to build large-scale multiplayer games using a cloud-based solution", developer AtomiCal. Those developers would do well to visit Epic's Unreal Dev Grants webpage and anyone anxious about the controversy impacting their gaming should keep an eye on Improbable's blog.

Variety tried to contact Unity for comment and will update this story when we hear back. 'We terminated our relationship with Improbable due to a failed negotiation with them after they violated our Terms of Service.

Improbable went on to say that a platform going down or changing its Terms of Service could have "devastating repercussions" on the industry and called on Unity and others to create a "code of conduct" to adhere by.

The way Improbable told it this morning, Unity changed their Terms of Service last month and then, without warning, pulled the rug out from under them.

Improbable has already been found in violation of Unity's terms (a violation the company refutes in this latest post) and had its Unity licenses revoked as a result.

"We are genuinely disappointed that we have been unable to come to an agreement with Improbable, and their improper use continued until we took the action we did".

An Improbable spokesman told Business Insider that it was hard to estimate the potential financial impact on the startup, but added that the situation with Unity was "unique".

We now hope Unity will seek to engage with us to solve this issue.

"If you want to run your Unity-based game-server, on your own servers, or a cloud provider that provides you instances to run your own server for your game, you are covered by our EULA", he explained.
