Sen. Mitt Romney, R-Utah, is among a handful of Republicans who have yet to announce how they'll vote.

Under a 1976 law, presidents have wide discretion in determining when a national emergency has occurred.

If that is the choice, Parliament will decide Thursday whether to seek an extension that would delay Britain's departure date. European Union envoys from the remaining 27 member states were due to meet at 0800 GMT on Wednesday to discuss next steps.

GOP Sens. Mike Lee of Utah and Todd Young of IN were also IN discussions with the White House about related legislation that would curb the ability of future presidents to declare national emergencies.

Lee's proposal says a presidential emergency would last 30 days unless Congress votes to extend it.

A vote on Lee's plan was expected after Congress returns from a recess later this month. Trump had repeatedly said Mexico would pay for the wall, which is not happening.

President Trump has rejected a GOP measure that would change the law on future emergency declarations, eliminating what appears to be the final last-ditch attempt to avoid the Senate publicly rebuking the President on his border wall declaration.

The senator cautioned that Trump's position may still change - "It is only Wednesday, and it is the Trump administration".

The strongest chance of blocking Trump's border emergency is likely several lawsuits filed by Democratic state attorneys general, environmental groups and others.
