A NY appellate court ruled Thursday that President Trump must face a defamation lawsuit filed by former "Apprentice" contestant Summer Zervos, one of about a dozen women who accused Trump of sexual misconduct shortly before the 2016 election.

"We will seek to appeal the majority decision to New York's highest court, the Court of Appeals, which we expect will agree with the dissent".

Mariann Wang, the lawyer for the plaintiff, Summer Zervos, argued that a president is not above the law and said the US Supreme Court's ruling in Clinton v. Jones backs up her argument that Trump can be sued in state court. She was among over a dozen women who came forward during Trump's 2016 campaign with allegations of sexual misconduct years earlier. She had claimed that Trump kissed her twice on the lips during a 2007 meeting at his office, and then he kissed and groped her the next time she saw him at a hotel where she had gone to join him for dinner.

In its ruling Thursday, a panel of NY appellate judges rejected that argument, citing the U.S. Supreme Court's ruling in Clinton v. Jones, which established that presidents can be sued while in office for unofficial acts.

In addition, according to Bragg, other cases were stalled in anticipation of the Zervos decision, including one by the New York State Attorney General against the Donald J. Trump Foundation. Her resolve to stay quiet changed, she said, after an "Access Hollywood" recording emerged in October 2016 of Trump boasting about groping women.

Trump's attorneys had argued that the suit could not move forward because it would violate the Supremacy Clause-which elevates the Constitution and federal laws over state laws-by interfering with Trump's ability to do his job. They also say his comments were opinions and protected free speech.

Attorneys for President Trump argued that as President, he can not be sued.

All five justices found Zervos' defamation claim legally sufficient, without ruling on its merits.

Trump has denied Zervos' claims and called her case politically motivated.

That paved the way for Mr Clinton's impeachment the following year.

"The current sitting President attempts to shield himself from consequences for his alleged unofficial misconduct by relying upon the constitutional protection of the Presidency", Justice Dianne Remwick wrote Thursday in decision to reject the motion to dismiss (read it here).

Trump also faced a defamation claim by adult film actress Stormy Daniels in her lawsuit over a hush money agreement. "Notwithstanding that concern, this Court should not be deterred from holding that a state court can exercise jurisdiction over the President as a defendant in a civil lawsuit".
